Annual HOA Dues and Maintenance Fees
Dues for the Gardens of Hartland are $2,000 for each calendar year. Residents are welcome to pre-pay the full amount of the annual HOA dues and maintenance fees at the beginning of the year.
Following are the rules governing dues collection that were unanimously adopted by the Board of Directors on February 25, 2025:
1. Quarterly Dues must be paid during the month in which they are invoiced.
2. A $30 late fee will be added on the fifteenth day of each month after the due date; it will be added every month until the FULL amount of quarterly AND late fees is paid.
3. Partial payments do not reduce or eliminate late fees. For example, 1Q dues that are paid on April 1 will incur 2 months of late fees, or $60.
4. If a check is delivered by USPS postmarked prior to the due date, HOA will remove the late fee.
Any fees incurred by the HOA for stop payments on checks or credit card disputes will be billed directly to homeowner or added to homeowner dues.
5. Written Notification (USPS mail and/or email) of intent to file Lien will be sent to homeowner of record at the end of the third month of outstanding and unpaid dues.

- First, send the letter using USPS Certified Mail with the required signature return card. (Least cost and shows proof of verified attempt)
- Second, If it is undeliverable via USPS, consider making the notification via process server, if Board feels this extra step is warranted. (Increased cost and verified proof from face-to-face contact with person)
6. Homeowners may submit a written Letter of Appeal to the GOH Board (gardensofhartland@gmail.com) to dispute late fees and/or liens within 7 days of the end of the 3rd month of unpaid dues. If the GOH Board has NOT received a Letter of Appeal during this time, a lien will be filed within 14 days after the 3rd month in which unpaid dues are incurred.
7. To remove the lien, the homeowner will owe:

- All overdue HOA and maintenance fees
- All late fees, which will continue to accrue during the life of the lien
- The lien filing and release fees
- An administrative fee of $250
- Attorney fees of $450
- Any additional fees accrued during the life of the lien
8. Legal action for collection of dues may be initiated against the homeowner 30-60 days after placement of lien.

For centuries, many cultures and religions have revered and honored the elderly members of their societies. There is a though that this population of people has contributed and paved the way for the present generation. There are a significant number of residents in our community that are successfully aging in place.

Landscaping
Landscaping Policy
The Gardens of Hartland provides mowing services to residents:
- Mowing services are scheduled weekly, usually on Thursday. Where possible, a mowing skipped due to severe weather will be rescheduled for the following day without further notice to residents. If that is not possible, the mowing will be rescheduled as soon as practical or cancelled entirely and the change in schedule will be communicated to residents via email.
- The duration of this service is up to 30 weeks, beginning in April and extending through October, assuming weather conditions do not preclude grass growth (ex: severe drought). There is no rebate for unused mowings.
- The mowing crew will alternate where mowing begins, i.e. the front or back of the neighborhood, each year. This is not guaranteed and may be subject to change depending on the personnel who perform the service at any given time.
- The mowing crew will bag lawn clippings when they deem the grass clumps to be large enough to damage the lawn. Lawn clippings will not be removed from planting beds.
The Gardens of Hartland provides the following landscaping services in the common areas:
- Weekly mowing. Please note that all caveats listed above also apply here.
- Maintenance of trees, shrubs, and flowers.
- Maintenance of fences, drains, and basins.
- Maintenance of irrigation systems in the common areas.
Residents are responsible for the following landscaping services:
- Irrigation: Turning on and turning off (winterizing) irrigation systems in their yards. The Gardens of Hartland has contracted with Green Akers for this service; 2025 prices are $50 per service, per house.
- Mulching of planting beds
- Maintenance of shrubs, trees, and mandatory street trees.
- Obtaining HOA approval for landscaping changes to the property. As a reminder, all exterior changes including, but not limited to, landscaping changes, decks, exterior changes to the home, fences, generators, patios, retaining walls, and roofing must be approved by the HOA in advance of implementation.

Pool membership
Grandchildren 16 and under may use the pool as well; they must be accompanied by the grandparent who has a current pool membership at all times. To register your grandchildren, send an email with their name, complete birth date, and a photo (head shot only please) to gardensofhartland@gmail.com.
Roofing materials
There are two specific shingles that have been approved for use in the Gardens of Hartland:
Owens Corning 'Driftwood'
GAF 'Weathered Wood'
All other shingles require Board approval. If you would like to use any other shingle, please contact the Property Manager prior to making any commitments; the Property Manager will work directly with you to obtain a decision from the Board.
Snow and Ice Removal
As a service to members, the Gardens of Hartland Homeowners Association (GOH HOA) strives to maintain a contract for snow removal each winter that provides for removal of snow from driveways and sidewalks adjacent to homes in the Gardens of Hartland and preventative chemical treatments where practical. Due to the complexity of timing and difficulty in execution without damage to driveways and sidewalks, ice removal services will no longer be contracted by the GOH HOA.
In general, snow removal will not begin until the snow event concludes with a snow accumulation of 4” or greater. Snow removal is at the discretion of the Board of Directors and any deviation from the criteria listed above will be disclosed to Association members.
Removal of snow from the city streets in the Gardens is the responsibility of Lexington-Fayette Urban County Government (LFUCG) but may be considered in extreme weather conditions to ensure accessibility to the neighborhood for residents and emergency response vehicles.
Residents are required to keep their sidewalks and driveways clear of storm debris, trash receptacles, vehicles, and decorative objects during snow events. Snow removal will be skipped for properties where sidewalks or driveways are not clear of objects, including parked vehicles. If skipped, snow removal will not be rescheduled for a later time or date.
Residents may ‘opt out’ of HOA provided snow removal services by completing the electronic form on the Gardens website. A reflective sticker will be placed on the mailbox of any home opting out of snow removal services to signal to contractors to bypass snow removal services for that property.
Finally, residents should be aware that any snow removal contract for the Gardens may be executed after snow removal for zero tolerance facilities (hospitals, medical facilities, etc.) and other commercial clients. The priority of snow removal from sidewalks and driveways can also change based on the availability of contractor equipment and personnel in a snow event.
Street Trees
Homeowners are responsible for maintaining street trees in the easement between the sidewalk and the street adjacent to their property. The number of street trees required for a specific property is documented in the plat. The majority of Gardens homes require at least two street trees. If you are unsure of the number of street trees required for your property, contact Lisa Richardson for that information.
Per LFUCG ordinance, street trees (and trees overhanging the streets) must be pruned to at least 7' above the sidewalk and 12' above the street. This allows vehicles to pass safely under the trees and pedestrians to safely use the sidewalks. It is not legal to top street trees, i.e. you may not cut the main trunk for the purpose of making the tree shorter.
Removing, replacing, or adding street trees requires a permit from LFUCG. The homeowner is responsible for obtaining an approved permit prior to removing, replacing, or adding a street tree; click here to access the LFUCG permit application.
The city sometimes sponsors a cost sharing programs for up to 50% of the cost of a street tree in owner occupied homes. Click here to learn more about street trees and the potential for financial assistance from the city.
While the city maintains a list of acceptable street trees by size, the Gardens has selected the following 'medium' sized trees as being suitable for the 5' easements and uniform in growth rate and shape. These trees will form a canopy of 25 - 50'.
Black Gum (Nyssa sylvatica)
- 20–25 meters (66–82 ft) tall
- 20" - 39" diameter trunk
- straight trunk with the branches extending outward at right angles
- bark is dark gray and flaky when young, but it becomes furrowed with age
- foliage turns purple in autumn, eventually becoming an intense bright scarlet
- berries in autumn
- grow best on well-drained, light-textured soils
Hedge Maple (Acer campestre)
- 25 to 35 feet tall and wide
- dense, rounded canopy
- dark green leaves that turn yellow or golden in fal
- small, greenish, inconspicuous flowers, followed by winged samaras
- prefer rich, well-drained soils and can tolerate partial shade
- adaptable to dry soils, soil compaction, and air pollution
Hophornbeam (Ostrya virginiana)
- usually an understory tree, they grow up to 40 feet tall
- usually spread slightly less than their height
- spring flowers are small, usually 1" - 2", female flowers turn into small nutlets
- yellow foliage in fall
- tolerates clay soil, deer, drought
Thornless Honey Locust (Gleditsia triacanthos var. inermis)
- grows 30-70' tall and wide
- rounded crown, feathery foliage
- bright green leaves turn yellow in the fall
- small spring flowers (sometimes fragrant) turn into 10" seed pods in the fall
- tolerates wide range of soils, drought, road salt, urban pollution
Trident Maple (Acer buergerianum)
- grows to a height of 25-35 feet and a width of 15-25 feet
- rounded, spreading form
- leaves are glossy dark green above and paler underneath, turning yellow to red in autumn
- prefers full sun but can tolerate shade
- moderately drought tolerant
- tolerant of wind, salt, drought, air pollution, and even some soil compaction
- can be used as street trees, especially if trained to have a single leader
Yellowwood (Cladrastis kentukea)
- 30' - 50' tall
- compound leaves in groups of 8-11, turning yellow in autumn
- prefers full sunlight, well drained soil
- can withstand urban settings
- attractive to birds
- sometimes trunk will divide low to the ground
Please *do not* select a different species from the city's list of approved species, as some of them are more prone to break or damage sidewalks, are more prone to insect infestations or disease, or have a low canopy that could be impacted by city trash pickup.
The city arborist strongly recommends diversity in street trees to improve the long-term health of the neighborhood tree canopy. Monocultures, as originally designed for the Gardens, can result in catastrophic tree loss due to a single insect infestation or tree pathogen (ex: Green Ash).

Turf applications
The Gardens of Hartland Homeowners Association provides a turf maintenance program for residents. Any property owner wishing to opt out of this service must complete a written request using this form; there are no rebates or refunds for property owners opting out of turf applications.

Vehicles
Per the Covenants and Restrictions, Section 11. VEHICLES:
"No trailer, truck, commercial vehicle, camping trailer, camping vehicle or boat shall be parked or kept on any lot at any time unless said vehicle is housed in a garage or basement (pick-up trucks used for daily transportation excepted). No inoperable vehicle shall be parked on any lot or street unless housed in a garage, and no vehicle shall be parked on any street in the Subdivision for a period in excess of twenty-four (24 hours). Overnight parking on the street is prohibited. Any and all vehicle maintenance shall be conducted within close proximity of the garage entrance. No such routine maintenance shall be permitted on residential streets."
NOTES:
Jet Skis: For the purposes of enforcement of these covenants and restrictions, jet skis are considered to be 'boats' and will be managed accordingly.
Overnight visitors: We understand that during holidays and family celebrations, there may be overnight guests that cannot park inside a garage. Please move all visiting vehicles to the driveway for overnight parking.
